Framework Terms for Buying Content.

If you wish to buy or sell any subscription to an Artist Club or any Digital Content on the Site, please read the following Framework Terms for Buying Content (the “Framework for Buying”). You may select respective content you would like to buy online. Show4me is determining only framework (‘community’) rules in this Framework for Buying. Artists will act as the ‘Content Sellers’ and will offer you commercial terms (for example, price per item) and such terms will also incorporate the same principles as determined in this Framework for Buying.

“Content” and/or “Digital Content” – shall mean downloadable Content and/or the subscription to Artist Club for the purpose of these Framework for Buying. For the avoidance of doubts, “download”, “downloading”, “downloaded” shall include “subscription to Artist Club” as well.

For the avoidance of doubt, Show4me is provider of software and hosting services to the ‘Content Sellers’ and the latter own copyright and other rights to sell you the selected content. However, Show4me is engaged in fair rules and excellent system operation to best of your satisfaction as the customer, we may be your helpdesk or point of contact in some specific cases described below.

Summary of some of your key rights:

You have a 14 days money back right to change your mind and get a full refund on purchased Digital Content – prior to content becomes available for downloading. You do not have this money back right once content becomes available for downloading. Prior to start of download you will have another secure warning or pop-up message.

The Content Seller shall offer its own Digital Content as described, fit for purpose and of good quality.

  1. if your Digital Content is faulty, you’re entitled to a repair or a replacement;
  2. if the fault can't be fixed, or if it hasn’t been fixed within a reasonable time and without significant inconvenience, you can get some, or all of your money back;
  3. if you can show the fault has damaged your device and the Content Seller hasn't used reasonable care and skill, you may be entitled to a repair or compensation.

This is a summary of some of your key rights in front of the Content Seller.

Important information on downloading costs and ‘bill shock’:


When you buy Digital Content, it will become available for download onto your computer or device – the grey download button will become color to show this availability. Please carefully check the file size of selected Digital Content as using too much data might mean that you exceed your memory capacity limit on your device or you could face paying more for internet traffic than you were expecting, particularly if you are using your mobile phone in roaming.

In this Framework for Buying:

  1. Any terms found herein that have been defined in the terms of use of the Site and not herein shall take the meaning given to them in the terms of use of the Site.
  2. “Seller” and/or “Content Seller”, means the Artist, who is a seller that makes the sale via the Site, which is a third-party User of the Site and is not the same party as Show4me;
  3. “You”, “you” or “your” means the person buying Digital Content from the Content Seller; and
  4. The “site” means this website, which is owned and operated by Show4me, and is accessible via the following URL: www.show4me.com and/or any of our mobile applications connected with the same.

  • by submitting your request via Send feedback form. The support team will respond as soon as possible generally within 24 hours.

1. Binding rules and terms

  • 1.1 This Framework for Buying is only available in English.
  • 1.2 The buying content and/or the subscription to the Artist Club is normally explicit, easy and user-friendly procedure. However, when buying any Digital Content you also agree to be legally bound by:
    • the site’s Terms of use and any documents referred to in them;
    • extra terms which may add to, or replace some of, set hereby. This may happen for regulatory reasons. The Content Seller will contact you to let you know if the Content Seller intend to do this by giving you one month's notice; and
    • specific terms which apply to certain Digital Content. If you want to see these specific terms, please visit the relevant webpage for the Digital Content.

2. Your privacy and personal information

  • 2.1 Site's “Privacy Policy” is available at https://help.show4me.com/help_center/privacy_policy.
  • 2.2 Your privacy and personal information are important to Show4me. Any personal information that you provide to Show4me will be processed in line with Site's Privacy Policy, which explains what personal information Show4me collect from you, how and why Show4me collect, store, use and share such information, your rights in relation to your personal information and how to contact Show4me and supervisory authorities in the event you have a query or complaint about the use of your personal information.

3. Buying Digital Content from the Content Seller

  • 3.1 Below, is set out how a legally binding contract between you and the Content Seller is concluded and performed.
  • 3.2 You place an order for Digital Content (the “Order Procedure”). Please read and check your order carefully before submitting it. However, if you need to correct any errors you can do so before submitting it to the Content Seller. In any event, before you place your order you must check that the hardware and software requirements of your computer or device mean that you can download the Digital Content.
    • When you place your order at the end of the online purchase process (eg when you click on the ‘Buy’ button), you will be able to click on a ‘Download’ button. When the transaction is fully complete, you will receive an email detailing certain information relating to your transaction (which does not mean that your order has been accepted), including without limitation:
      • Album title;
      • Artist name;
      • Album price;
      • Commission payable;
      • Transaction ID;
      • Purchase Date; and
      • Purchase time.
    • The Content Seller may contact you to say that the Content Seller does not accept your order. This is typically for the following reasons:
      • the Digital Content is unavailable;
      • your payment cannot be authorised;
      • you are not allowed to buy the Digital Content from the Content Seller;
      • the Content Seller is not allowed to sell the Digital Content to you; or
      • there has been a mistake on the pricing or description of the Digital Content.
    • The Content Seller and Show4me only accept your order when The Content Seller makes available the applicable Digital Content for your listening and download on the site. At this point (“Digital Content becomes available”): a legally binding contract will be in place between you and the Content Seller.
  • 3.3 If you are under the age of 18 you may not buy any Digital Content from the site.

4. No right to cancel this contract once the Digital Content becomes available

  • 4.1 When you buy the Digital Content:
    • you have no right to cancel this contract once the Digital Content becomes available; and
    • you must read the following statement, agree to it, and tick the relevant box when buying the Digital Content: ‘By clicking on the ‘Buy’ button, you make an offer to the Content Seller and you acknowledge that after the Digital Content becomes available you will lose your right of withdrawal from the contract with the Content Seller’.

5. Permission to use the Digital Content

  • 6.1 When you buy the Digital Content and download it (see clauses 3.2, 3.3), you will not own it. Instead the Content Seller gives you permission to use it (also known as a ‘license’) for the purpose of you using and enjoying it.
  • 5.2 Digital Content:
    • is personal to you. You can use it wherever you want in the world but only if you comply with local laws;
    • is non-exclusive to you. The Content Seller may supply the same or similar Digital Content to other users;
    • is intended only for your personal non-commercial use;
    • may not be:
      • copied by you except for a reasonable number of necessary back-ups;
      • changed by you (which means, in particular, that you are not allowed to adapt, reverse-engineer or decompile it, or try to extract the source code from it, except where any of this is allowed by law);
      • combined or merged with, or used in, any other computer program;
      • distributed or sold by you to any third party;
    • does not include:
      • updates;
      • upgrades;
      • new releases;
      • new versions; and
    • contains information which is owned by the Content Seller or third parties or both. You must not conceal, change or remove any markings which show who owns this information, such as copyright (©), registered trademark (®) or unregistered trademark (™) markings.
  • 5.3 Except where you have permission to use the Digital Content under this clause 5, you will not obtain any rights of ownership or other rights (of whatever nature) in the Digital Content or in any copies of it.

6. Download

  • 6.1 Once you have clicked on the ‘Buy’ button (see clause (4.1)) and the Digital Content becomes available (see clause 3.2 you will be given the option to download the Digital Content by clicking on the ‘download’ button).
  • 6.2 If something happens which:
    • is outside of Show4me’s control; and
    • affects you being able to download the Digital Content,
  • you will have a revised time for when you can expect to be able to download the Digital Content.
  • 6.3 The Content Seller may at certain cases, in particular upon free decision, stop selling Digital Content, and Show4me does not control Content Seller’s intent to provide continuous service. With respect to downloadable content the Content Seller has no right to cancel particular download once a download has started, however it may do not accept your next order. If the Content Seller stops all sales, your contract with the Content Seller shall be deemed terminated, which does not impair your rights to the previously downloaded Content.
  • With respect to the subscription to Artist Club the Content Seller has no right to cancel subscription by subscription expiration date. If you purchase a subscription to Artist Club, your payment for such subscription to Artist Club will automatically renew at the end of the applicable subscription period, unless you cancel your subscription to Artist Club before the end of the current subscription period. The cancellation will take effect the day after the last day of the current subscription period.
  • 6.4 You understand and agree that Show4me is a site that Content Sellers use to sell the content is derived from files provided by the relevant Content Seller, and the relevant Content Seller is solely responsible for such files.
  • 6.5 Digital Content and subscription to the Artist Club you purchased cannot be guaranteed to be available to you perpetually. For example, if we receive a notification of claimed infringement from a copyright owner or its agent with respect to specific Content, then Applicable Law may require us to remove that Content from the Service and not make it available for future sale and we may also have to deny continued access to anyone who previously purchased such Content. This means that you may lose access to purchased Content previously available to you through the Site.
  • 6.6 Because there is a possibility that we may be required to deny you access to previously purchased Content, we encourage you to promptly download any Content you purchase through the Site to your own devices so that you will retain control and possession of such Content even if we are required to remove the Content from the Site.
  • 6.7 Users bear all risk from the denial of access to any Content purchased through the Distribution service.

7. Payment

  • 7.1 You may to pay with the following credit cards and debit cards: CB, VISA, MASTERCARD, Maestro, Diner’s Club.
  • 7.2 Your credit card or debit card will only be charged when you click on the ‘Buy’ button.
  • 7.3 All payments by credit card or debit card need to be authorised by the relevant card issuer. Mangopay may also need to use extra security steps via:
    • Verified by Visa;
    • Mastercard®SecureCode™ etc.
  • 7.4 The price of the Digital Content, payment terms and any specific conditions relating to the Digital Content will always be detailed by the Content Seller on the applicable page of the Site.
  • 7.5 Invoice for the Digital Content is issued by the Content Seller. The Content Seller will normally use our software to produce invoices. Such invoices may bear Show4me logo or any other information on Show4me as an automated system engaged in producing invoices.
  • 7.6 Show4me does not possess electronic wallets used by Content Sellers for receiving funds collected from the Content sales.

8. Nature of the Digital Content

  • 8.1 If you are located in the UK, and in certain other jurisdictions you have certain legal rights (also known as ‘statutory rights’), for example, that the Digital Content:
    • is of satisfactory quality;
    • is fit for purpose; and
    • matches its description.
  • 8.2 The Content Seller must provide you with Digital Content that complies with your legal rights.
  • 8.3 When the Content Seller supplies Digital Content:
    • the Content Seller will use all reasonable efforts to ensure that it is free from defects, viruses and other malicious content;
    • Show4me do not promise that it is compatible with any third-party software or equipment except where Show4me have communicated that it is in the guide to its use or on the site; and
    • the Content Seller acknowledges that there may be minor errors or bugs in it.

9. Faulty Digital Content

  • 9.1 A summary of some of your key rights are set out at the top of Framework for Buying. For more detailed information on your rights and what you should expect, please:
    • Visit the site: “Our and the Content Seller’s promises to you if things go wrong”; or
    • contact Show4me using the contact details at the top of this page.
  • 9.2 Nothing in this contract affects your statutory legal rights. You may also have other rights in law.
  • 9.3 Please contact the Content Seller using the contact details at the top of this page, if you want:
    • the Content Seller to repair the Digital Content;
    • the Content Seller to replace the Digital Content;
    • a price reduction; or
    • to reject the Digital Content and get a refund.
  • 9.4 To avoid faults in the Digital Content happening, you must:
    • where applicable, install any fixes, updates, upgrades, new releases and new versions as soon as reasonably possible after you are notified that they are available to be downloaded;
    • use it only on the recommended third-party software and equipment set out in the guide to its use or on the site.

10. Limit on Show4me’s responsibility to you

  • 10.1 Except for any legal responsibility that Show4me cannot exclude from the law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, Show4me is are not legally responsible for:
    • losses that:
      • were not foreseeable to you and Show4me when the contract was formed; or
      • that were not caused by any breach on Show4me's part;
    • business losses; and
    • losses to non-consumers

11. Third party rights

  • 11.1 No one other than a party to this Framework for Buying has any right to enforce it.

12. Our and the Content Seller’s promises to you if things go wrong

  • Get a refund, repair or replacement
  • Repair or replacement

    The Content Seller, which is a third-party User of the Site and is not the same party as Show4me, has one opportunity to repair or replace any goods or Digital Content that are of unsatisfactory quality, unfit for purpose or not as described, before you can claim a refund.

    You can choose whether you want the Digital Content to be repaired or replaced, but the Content Seller can refuse if they can show that your choice is disproportionately expensive compared with the alternative.

    You’re entitled to a full or partial refund instead of a repair or replacement if any of the following are true:

    • The cost of the repair or replacement is disproportionate to the value of the Digital Content;
    • Repair or replacement is impossible;
    • Repair or replacement would be significantly inconvenient;
    • Repair would take unreasonably long;
    • Repair has been unsuccessful.

    If the attempt at a repair or replacement is unsuccessful, you can then claim a refund or a price reduction if you wish to keep the product.

    If you don’t want a refund and still want your product repaired or replaced, you have the right to request that the Content Seller makes further attempts at a repair or replacement.

    The Content Seller will also have to compensate you if any device or other Digital Content you own is damaged as a result of the faulty Digital Content you’ve downloaded.

    This applies where that damage would not have occurred had ‘reasonable care and skill’ been exercised in the provision of the Digital Content, even if that content was provided free of charge.

  • Cancelling a digital download

    Digital downloads are given their own unique category and are therefore not services or goods.

    If you want to download something within 14 days of buying it, you will have to give your consent to waive the 14-day cooling-off period.

    If you don’t give your consent, the 14-day cooling-off period still applies, but you won’t be able to download your Digital Content until this period has ended.

    This is to prevent you from changing your mind after you have downloaded the content.

  • Before you buy:

    Check the version and format of the download;

    Read reviews of the download before you commit;

    Check whether you’re agreeing to download your item before your cancellation period ends.

  • Getting a refund on a download

    If you’ve made a genuine mistake with a download purchase, it’s worth contacting the Content Seller to see if you can get a refund or exchange the download for the one you really want – you’ve nothing to lose.

  • Next steps

    If you can't agree a solution directly with the Content Seller, the Content Seller must provide you with certain information required by law about alternative dispute resolution provider offering services in your sector.
